Requirements

Client is responsible for providing prompt and impartial administrative hearings, and issue timely and accurate written hearing decisions which review local social services district, managed care plan, and Client determinations regarding social services benefit programs. OAH also presides over administrative hearings for other State agencies. OAH annually receives approximately 200,000 fair hearing requests. Hearings are adversarial in nature. Appellants are generally pro se. Audio recordings are maintained of all hearings. Almost all hearings are conducted telephonically.

Requested Services:

Paralegal services are required so that Client OAH can issue written fair hearing decisions in a timely manner. OAH seeks up to 20 full-time Paralegals from Bronx, Kings, New York, Queens and Richmond Counties to draft decisions after fair hearings based on written guidance from the presiding Administrative Law Judge, evidence, audio recordings, and standardized, proprietary decision drafting software. Paralegals may be directed to listen to hearings as they happen and state their appearance on the record.

Administrative Law Judges will provide Paralegals with recommended outcomes, credibility assessments, and other relevant information required for Paralegals to utilize proprietary decision drafting software to create a draft decision including correct and relevant law, findings of fact, analysis, and directives.

Services will be provided Monday through Friday, 9:00am to 5:00pm, eastern time, in accordance with New York State’s official work schedule. All Paralegals are to work 7.50 hours each day, allowing for a 30-minute lunch break. Two fifteen-minute breaks, one in the am hours and one in the pm hours are allowed on state time. Breaks may not be used to shorten the workday.

Prospective candidates may have the option to work 100% remote, Hybrid, or 100% in office at 5 Beaver Street, New York, NY 10004. All Paralegals, even those working remotely, will have to report to the OAH office location, 5 Beaver Street, New York, NY 10004, when directed: to obtain and return equipment; for purposes of training; to resolve equipment issues; and, if/when operationally required.

Paralegals will work under the direct supervision of an OAH attorney. Paralegals must have knowledge of basic legal processes; legal terminology and legal forms; legal research techniques; ability to read, understand, and interpret laws, legal documents, and other written material Paralegals must: use Client equipment as required - including, but not limited to, an Client issued computer and Microsoft Suite software; understand, speak, and write English; raise safety and professional concerns to direct supervisor(s); complete assigned trainings; and develop competency with OAH’s proprietary decision drafting software.

Paralegal Requirements:

Paralegals must:

  1. Be professional and provide drafted decisions in the timeframe provided.
  2. Possess paralegal certification.
  3. Have a minimum of two years of experience providing complex clerical level legal support services to an attorney.   

D) Have excellent verbal and written communication skills, an understanding of legal

language and principles, and strong organizational and analytical skills.

E) Maintain confidentiality and agree to non-disclosure agreements maintained by the  

     Contractor and available for inspection by Client (See Attachment A).

F) Access systems and complete all assignments within the 48 contiguous United States and the District of Columbia.
